Aileen Brennan concentrates her practice in the fields of redevelopment, land use, and eminent domain. She handles transactional and litigation matters, as well as entitlements. She has extensive experience in negotiating and drafting redevelopment agreements and associated documents and legislation. Aileen has also drafted and defended zoning and land use ordinances.

Aileen has successfully challenged land use board decisions in both New York and New Jersey, and has successfully defended redevelopment designations and agreements in Superior Court in New Jersey.

Representative matters include:

• the negotiation of the rehabilitation of a landmark building into four stories of affordable housing, including partial financing with guaranteed loan funding made available by the United State Department of Housing and Urban Development
• condemnation proceedings necessary for the assemblage of a critical development site in Newark that is now the site of a warehouse, which has generated 300-400 new jobs
• successful appeal of a land use board’s refusal to issue a development permit
• approval of and defense of use variances for various solar projects
• defense of controversial zoning ordinance, ensuring the feasibility of critical development near Newark Penn Station
• negotiation of multiple redevelopment and PILOT agreements along the New Jersey waterfront.

Aileen has also counseled businesses and communities related to aviation and airports regarding compliance with federal and state environmental regulations, including the development of OSHA-required coursework for airport employees. Before she was an attorney, Aileen was a duty manager for a major airline.

Ms. Brennan founded the Land Use and Redevelopment Committee of the Essex County Bar Association and is a member of the Aviation Law Committee of the New Jersey Bar Association and the Air and Space Law Committee of the NYC Bar. She enjoys traveling, reading, and trying new foods.
